Against the backdrop of tension between Katz and Bluth: The demand of the activist at the center of the struggle
The controversy surrounding Tal Yinon Dardik's administrative order has become a political battleground, peaking with the Defense Minister's unusual meeting with him during his hunger strike. Tomorrow, a court hearing will address the fear of creating a dangerous legal precedent that could also serve Palestinian terrorists under administrative house arrest in the future.
The administrative detention case of Tal Yinon Dardik is escalating: Dardik, who has been held under an administrative order and on a hunger strike for 30 days, has sent a pre-legal action notice to the Ministry of Defense and security establishment officials. In the letter, submitted via attorney Menashe Yado of the 'Honenu' organization, Dardik demands an official clarification and apology following reports linking him as a 'prime suspect' in the violent incident at Khirbet Khumsa — a claim he vehemently denies.
In his letter, attorney Yado argues that portraying Dardik as a central participant in the attack on Palestinians is fundamentally baseless. While other suspects in the case were arrested for two weeks, Dardik was interrogated for less than an hour and released to his home without restrictive conditions. Conversely, the security establishment claims there are indications of his presence at the scene, but insufficient evidence to file an indictment — which led to the imposition of the administrative order.
As recalled, the affair has been causing an unprecedented confrontation in recent weeks between Minister of Defense Israel Katz and the GOC Central Command, Major General Avi Bluth. The order issued by Bluth required Dardik to stay at his mother-in-law's house, and after the army claimed he violated the conditions, he was arrested. The Military Court of Appeals subsequently ruled that the order is not applicable in its current format and that an alternative residence must be found.
This decision opened a legal front: the IDF and the State Attorney's Office filed an appeal to the Jerusalem District Court, partly due to sharp opposition to the state funding an alternative apartment for Dardik. The security establishment warns of a gateway to a dangerous legal and economic precedent, which could be used in the future by Palestinian terrorists under administrative house arrest.
The tension surrounding the affair reached its peak when Minister Katz met with Dardik during the hunger strike — an unusual step that drew sharp criticism within the security establishment. A few days later, Katz announced in a live broadcast his intention to appoint Major General Dado Bar Kalifa as GOC Central Command in place of Bluth.
The move, which was not coordinated with the Chief of Staff, triggered an unusual response from the IDF Spokesperson, who expressed full support for Major General Bluth. Although it has been clarified for now that Bluth is not being dismissed, sources in the security establishment and the settlement movement mark the Dardik affair as the trigger that turned a localized legal dispute into an open political and public battle.
Tomorrow (Thursday) at 9:00, the hearing on the appeal against the administrative order imposed on Dardik is expected to take place at the Jerusalem District Court. The hearing will deal not only with Dardik's personal circumstances, but with the limits of the authority of administrative orders, and the security establishment's fear of creating a precedent that will apply in the future to other cases as well. The 'Honenu' organization clarifies that if the security establishment does not publish the required clarification regarding Dardik's innocence in the Khirbet Khumsa incident, legal lawsuits will be filed on the matter.
