Court Rules Luna Park and Superland Must Provide Free Entry for Escorts of People with Disabilities
The Administrative Court in Jerusalem has rejected a request by "Ir HaShaashuim" to stay an accessibility order. Until the final ruling, the operator of the amusement parks must grant free entry to escorts of individuals with disabilities.
The Administrative Court in Jerusalem rejected today (Wednesday) the request of the company "Ir HaShaashuim", operator of Superland and the Luna Park, to stay the execution of an accessibility order issued by the Commission for Equal Rights of Persons with Disabilities.
The implication of this decision is that until a ruling is made on the petition filed by the company, it must comply with the order and grant an exemption from payment to the escort of a person with a disability who is entitled to it.
"The court determined that until a ruling is made on the petition, the company must act in accordance with the order and grant an exemption from payment to the escort of a person with a disability who is entitled to it," the State Attorney's Office stated.
The court further determined there was no basis to grant the request for an interim injunction. In its decision, it noted that the company had previously acted in accordance with the policy it is currently challenging, a fact that impacts the request to stay execution. Additionally, the court noted that at this stage, the chances of the petition succeeding remain unclear.
The Jerusalem District Attorney's Office (Civil), represented by Adv. Amir Shakar, acted on behalf of the Commission for Equal Rights of Persons with Disabilities and opposed the company's request to stay the order.
The court ordered "Ir HaShaashuim" to pay legal costs in the amount of 3,000 shekels. The petition itself will continue to be heard before the court, which will issue a final ruling at a later date.
