Attorney General to the Supreme Court: Allow the next government to decide on a commission of inquiry

Attorney General Gali Baharav-Miara submitted her response this morning (Wednesday) to the Supreme Court regarding petitions for the establishment of a state commission of inquiry into the October 7 massacre, suggesting that the next government be allowed to address the issue and make a decision.

"On a principled level," the Attorney General wrote, "in accordance with existing law, a state commission of inquiry is clearly the appropriate and dedicated legal tool for investigating the events of October 7 and the war, given its full professional independence and the severance of political ties, which befits the purpose of the investigation, its unprecedented characteristics, and its public importance."

"Despite the above," she added, "about two years and ten months have passed since the outbreak of the war, and the Israeli government has yet to reach a decision regarding the format of the investigation or the timing of its commencement. This state of affairs is highly exceptional, raises great difficulty, and has the potential to harm the effectiveness of the future investigation and lead to evidentiary damage."

"Although the passage of time raises great difficulty, since the government has not made any decision, and considering that we are in the midst of the election period for the 26th Knesset, and in light of the principles of restraint that apply to an outgoing government, it is proposed to allow the next government to address the issue and make a decision on the matter."
