Sale at a HOODIES outlet store: You will pay more for sizes above M

Different prices for different sizes at a HOODIES outlet store: A customer of the chain posted in the Urban Moms Tel Aviv Facebook group, claiming that the store discriminates between sizes and that "plus-size" women pay more in a sale she encountered. The customer approached the checkout with an item sold next to a sign reading "29.90 NIS for models participating in the sale." According to her, only when she went to purchase it was she told that for sizes above medium, the price is 39.90 NIS.

Although in another location in the store there were signs indicating a price of 39.90 NIS, the text on the signs was "models participating in the sale" and not "sizes participating in the sale." If this is indeed the case, there is a concern here of insufficient labeling according to the law or, apparently, misleading signage. She could not have guessed this from the sign, as it is common in the industry to have different pricing that distinguishes between different models in a sale, but it is less common and even very rare to make a distinction in the sale price between sizes, especially in common sizes like L and XL, which exist at HOODIES and are not considered extreme or non-commercial.

And this is what she wrote:

"Hi ladies. If there are women here above size medium, then hear a story. I passed by a HOODIES sale today, everything for 29.90 for selected models, or 39.90 for selected models. I saw sports pants and said, 'Okay, 29 shekels, I'll use it once anyway,' but then she told me at the checkout that it's not just by selected models, but that everything size after M costs 39.90 shekels. Now girls, listen. I have no idea if this is a common or accepted thing, but it's just not good. More than not good, it's bad. Next to me were two high school students who also took things, and so what, the one who took the same garment in Large and the one who took Medium will pay differently? You could somehow understand it for a really unusual size, but in a sale? When you wrote that the price depends on 'selected models' - and not 'on size M'. I asked the store manager for a refund, because it's illegal, she made a few calls and came back to me and, to her credit, gave me a refund, in accordance with the law and in accordance with what they advertised. Only thing is. While I was waiting to get the refund, I see them continuing to charge the same method to all the other customers. So go get the refund you deserve, and next time we'll buy at another store."

From the HOODIES chain it was stated:

"This is a sale at outlet fairs in malls. The chain has 2 outlet stores and 70 chain stores. The outlet stores operate on a different model than the chain stores and sometimes there are different prices between sizes of the same model, as part of a pricing policy based on inventory levels and demand."
