Attorney and mediator Yair Treibish, who specializes in the realization of medical rights and representation before the National Insurance Institute (Bituach Leumi), the Rehabilitation Department, and pension funds, regularly shares updates and case rulings on social media. He recently published details from a complex case involving a young man affected by the events of October 7.
The client, an educated man with an academic degree who immigrated to Israel from Europe and lives alone, was caught in the events of October 7 and has since struggled to rebuild his life. Attorney Treibish explains that sometimes, an injury sustained during a hostile act entitles one to a disability percentage that does not fully reflect the severity of the damage.
In this case, it was decided to act strategically to obtain additional recognition under the general disability track, considering the client's broader difficulties beyond the direct impact of the hostile act.
The medical committee that examined the insured and reviewed his documents was impressed by his mental state and decided to accept the arguments. As part of the official conclusions, the young man was assigned 40% temporary disability due to an adjustment disorder stemming from the hostile events and the challenges of living alone after immigrating to Israel.
This disability status is valid until January 31, 2028. At the same time, the committee recommended a 65% loss of earning capacity for the period between March 2025 and January 2028. In its decision, the committee specified that the insured requires flexible working hours and is capable of returning to work only on a part-time basis.
Another detail that emerged from the committee's protocol concerns weapon licensing. The committee informed the insured that a formal inquiry would be conducted regarding his handgun possession, given his use of licensed medical cannabis.
Ultimately, the medical committee's determination will help the client receive, beyond the monthly allowance, eligibility for an extensive rehabilitation package—a substantial step that will help him return to a normal life path and provide the necessary support he needs.
