Insurance Company to Pay 800,000 Shekels Following Traffic Accident
A short drive home for a 24-year-old man ended in a serious accident that initially appeared minor but resulted in lasting health issues. Following legal intervention, the insurance company 'Clal' agreed to a settlement.
A 24-year-old Jerusalem resident was involved in a severe traffic accident while driving home from a local mall. A taxi cut into his lane, causing his vehicle to nearly flip and triggering airbags that struck him with significant force, leaving him bruised and in pain.
After being treated at Hadassah Ein Kerem Hospital and discharged, the young man’s condition deteriorated over the following weeks. He began suffering from persistent body and neck pain, dizziness, tinnitus, and hearing loss, which severely hindered his work as a computer technician.
Seeking legal recourse, the man turned to Adv. Itamar Ben Ami, who filed a lawsuit in the Bat Yam Magistrate's Court against 'Clal' insurance company. The claim sought compensation for physical and mental damages, loss of earning capacity, and medical expenses.
"My client's profession requires prolonged concentration and mental effort. The pain and balance impairment have significantly harmed his ability to function and earn a living," stated Adv. Ben Ami.
'Clal' initially disputed the severity of the injuries and offered a low settlement. However, after the court-appointed medical experts confirmed a permanent neck disability and balance issues, the company opted to settle rather than continue litigation.
Under the terms of the agreement, 'Clal' will pay the young man 800,000 shekels in exchange for a waiver of future claims. The settlement was officially validated as a court judgment by Judge Shari Sadri Makover of the Bat Yam Magistrate's Court.
