National Insurance Institute approves allowances: Details of the decision

Many cases prove that not every injury is purely orthopedic; sometimes there is a neurological injury that was not initially examined, and it is this that can dramatically increase the total disability percentage.

According to the National Insurance Institute's medical disability rating document, the client was assigned temporary disability percentages for the period from 01/08/2026 to 30/06/2027. The decision includes:

• 20% disability for mild lower body weakness (Paraparesis, according to section 29(2)(a));

• 10% disability for bilateral carpal tunnel syndrome (MEDIANUS) with mild functional impairment in the right hand (according to section 31(4)(b));

• 5% disability for ulnar nerve injury (ULNARIS) with mild functional impairment in the left hand (according to section 31(5)(b)).

A medical calculation of these data places the cumulative medical disability at approximately 32% for a period of about 11 months.

Bottom line, if this is a work injury claim, the client will certainly receive a regular monthly allowance throughout the 11 months of temporary disability, as a disability rating of 32% exceeds the qualifying threshold (20% or more).

In contrast, if the claim is filed under the general disability track, the 32% medical disability rating allows the client to pass the medical threshold, but the actual receipt of the allowance is conditional upon an additional determination of the degree of incapacity for work (at least 50%). In other words: in the work injury track, the monthly payment is guaranteed now, while in the general track, it will be decided based on the impairment to his ability to work.
