Holmes Place Ordered to Pay 250,000 Shekels to Worker in Labor Ruling

A cleaning and maintenance worker at a Holmes Place fitness branch has been awarded 250,000 shekels after the regional labor court in Tel Aviv ruled that the chain served as his direct employer and failed to provide social benefits.

The plaintiff worked at the Givat Shmuel branch for approximately seven years until 2023. Holmes Place argued that the worker was employed via a contractor, but the defense was rejected after the chain failed to identify the contracting company or present proper pay slips. The court noted that the employee received 10,000 shekels in cash and worked under the direct supervision of branch managers.

Court Ruling and Dismissal Details

In April 2023, the worker was dismissed on the spot after a branch manager ordered him to stop his lunch break to fix a leak. When the employee asked to finish his meal, he was fired immediately. Judges Sharon Shavit-Kapturi and Dov Fest ordered Holmes Place to pay a quarter of a million shekels covering wage differentials, social benefits, overtime pay, wrongful termination compensation, and legal fees.

The defendant functioned as the direct employer during the relevant period, given the complete integration into branch operations and the lack of any documentation regarding an external contractor, the ruling stated.

Holmes Place stated in response that it is currently reviewing the court's decision.
