"Cracks and harmful gases": 20 million shekel lawsuit against Africa Israel Residences
Representatives of 12 residential buildings in Herzliya have filed a 20 million shekel lawsuit against Africa Israel Residences, alleging severe construction defects, ventilation failures, and safety hazards. The company denies the claims, asserting that the buildings were delivered in proper condition.
Representatives of 12 residential buildings in Herzliya, constructed by Africa Israel Residences, are suing the company for approximately 20 million shekels. The plaintiffs claim that the company was negligent in its construction, resulting in significant defects in common areas and a failure to fulfill its duty to address these issues.
The lawsuit, filed by attorneys Roni Alfasi and Tsarfati Haya, states that residents encountered numerous failures shortly after taking possession of their properties. According to the plaintiffs, their repeated attempts to resolve these issues were met with dismissiveness, denial, or inadequate repairs that failed to address the root causes.
Key Allegations
An expert report commissioned by the residents highlights that ventilation systems across all buildings are faulty. Specifically, the lack of proper air exchange in storage lobbies and community rooms has led to the accumulation of harmful gases, moisture, and mold. Other reported issues include rainwater infiltration in stairwells, advanced corrosion in solar system piping, and unusual noises in elevator lobbies.
Residents sharing the parking complex also cite multiple defects, including water leaks in fire sprinkler connections, cracks in walls and ceilings, and the absence of promised bicycle and motorcycle storage facilities.
Company Response
Africa Israel Residences rejects the allegations, stating:
"The buildings were handed over to the tenants in good condition and with a proper level of execution, in accordance with the company's obligations and high standards. Over the years, we have handled inquiries in cooperation with building committee representatives and the management company."
The company further noted that the last inquiry received from any of the residents was over a year ago. Africa Israel Residences has not yet received the formal statement of claim but intends to review the allegations and respond through the appropriate legal channels.
