Israeli Business Owner Detains Burglar, Ends Up Facing Criminal Charges
A northern business owner who detained a car burglar and called police now faces criminal assault charges after the intruder filed a complaint against him.
A business owner from northern Israel found himself facing criminal charges after detaining a burglar who broke into his car. What began as a textbook case of property crime took a shocking turn when the suspect claimed he was assaulted, leading prosecutors to file an indictment against the victim instead.
A Midnight Break-In and Confrontation
The incident took place around 2:00 AM near Tiberias. The owner, identified as Y., heard the sound of shattering glass from the parking area beneath his apartment. Armed with a screwdriver for self-defense, he rushed downstairs and caught the intruder inside his vehicle. Y. detained the man and immediately called the police.
When officers arrived, they arrested the suspect, who admitted to the break-in and claimed he was merely looking for a cigarette. Y. provided security camera footage documenting the crime, expecting swift justice. Instead, the tables were turned.
From Victim to Defendant
Although the burglar sustained no injuries, he alleged that Y. had assaulted him. Despite a lack of corroborating evidence, the police subjected Y. to a criminal investigation, culminating in an indictment for threats and assault filed by police prosecutors.
"We are the most normative people imaginable. Business owners caught in a situation where they were being robbed, and suddenly we are the ones who become the suspects," Y. shared in distress.
Public Defender Adv. Moti Melnik, representing Y., emphasized his client's clean record and lack of criminal history. "All he wanted to do was protect his home and property. He heard the shattering of a window and detained the intruder with his own hands, not knowing if others were present. In the end, he is the one facing an indictment."
Police Response and Legal Reality
In response, the Israel Police stated that a suspected property crime does not grant a license to use violence against a suspect. Authorities noted that separate indictments were filed against both individuals based on the evidentiary framework, alleging that Y. threatened and assaulted the suspect even though the intruder was not attempting to flee.
